SmartTasker Pty Ltd (SmartTasker) is the operator of www.smarttasker.au and its Mobile Applications (together, the ‘Services’).

This Privacy Policy describes how SmartTasker collects and uses your personal data. It describes who has access to the data collected. It sets out the rights of users of our Services, as well as SmartTasker’s obligations to them. It also describes SmartTasker’s cookie policy.

This Privacy Policy may be amended from time to time to maintain compliance with the law and to reflect any changes to our data collection process. When we amend this Privacy Policy, we will update the “Effective Date” at the top of this Privacy Policy. We recommend that our users periodically review our Privacy Policy to ensure that they are notified of any updates. If necessary, we may notify users by email of changes to this Privacy Policy.

This Privacy Policy applies in addition to the Terms and Conditions of our Services.

1. Consent

By using our Services users agree that they consent to the conditions set out in this Privacy Policy. They also consent  to the collection, use, and retention of the data listed in this Privacy Policy.

2. Personal Data We Collect

We only collect data that helps us achieve the purpose set out in this Privacy Policy. We will not collect any additional data beyond the data listed below without notifying you first.

When you visit our Services, we may automatically collect and store your IP address, location, hardware and software details, any links you click, any content you view, your advertising ID and your unique device ID.

We may also collect device and connection information such as statistics on your page views, traffic to and from the Services, referral URL, ad data, your browsing history and your web log information.

This data may also be collected when you create an account or interact with our Services. It may also be collected from the information from the devices you use when interacting with us or our Services such as device ID or unique user ID, device type, advertising ID and unique device token.

3. How We Use Personal Data

Data collected on our Services will only be used for the purposes specified in this Privacy Policy or indicated on the relevant pages of our Services. We will not use your data beyond what we disclose in this Privacy Policy.

The data we collect automatically, or when the user performs certain functions may be used for identification and authentication, to protect SmartTasker and the users of the Services, to customise the content and any advertising displayed on the Services and permit content on the Services (such as postings, marketing or third party advertisements) to be targeted, to provide, improve and personalise our Services, to provide, maintain and protect the Services and to verify the identity of authorised users of the Services.

We may also provide your information to a user with whom you have or had a contract facilitated by SmartTasker. We may also use your personal information for legal and compliance reasons, to ensure that SmartTasker receives payment of the fees due to it, to contact you to inform you about promotions or upcoming changes or improvements to the Services, or to contact you to administer our User Agreement.

4. Who We Share Personal Data With

We may disclose user data to any member of our organisation who reasonably needs access to user data to achieve the purposes set out in this Privacy Policy.

We may share user data with third parties such as Facebook, Google Ads, Bing, Google Marketing, Google Analytics or any other of our affiliated partners.

Data we share with third parties may include information about the pages you view, the links you click and other actions you take on our Services, or within our advertising or email content.

We may also share user data with third parties for the following purposes:

–           We may share your personal data with third party service providers that provide business, verification, professional or technical support functions for us, help us operate our business and the Services,

–           We may share your personal data with other third parties who participate in SmartTasker marketing initiatives and with consultants, advisors and analytics,

–           We may share information, such as ratings and reviews about you, with other users who are looking for taskers on the Services,

–           We may share your personal data to respond to judicial process or provide information to law enforcement or regulatory agencies or in connection with an investigation on matters related to public safety  and

–           We may share your personal data with any other third party with your consent or as necessary to deliver a service you requested.

Third parties will not be able to access user data beyond what is reasonably necessary to achieve the given purpose.

We will not sell or share your data with other third parties, except if the law requires it, if it is required for any legal proceeding, to prove or protect our legal rights and to buyers or potential buyers of this company if we seek to sell the company.

If you follow hyperlinks from our Services to another Site, please note that we are not responsible for and have no control over their privacy policies and practices.

5. How Long We Store Personal Data

User data will be stored until the purpose the data was collected for has been achieved. You will be notified if your data is kept for longer than this period.​

6. How We Protect Your Personal Data

We protect your information using technical and administrative security measures. Our safeguards include firewalls and data encryption, physical access controls to data centres and information access authorisation controls.

While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The Internet can be insecure at times and therefore, we are unable to guarantee the security of user data beyond what is reasonably practical.

7. Children’s Privacy

The minimum age to use our Services is 18 years of age. We do not knowingly collect or use personal data from children under 18 years of age. If we learn that we have collected personal data from a child under 18 years of age, the personal data will be deleted as soon as possible.

If a child under 18 years of age has provided us with personal data, their parent or guardian may contact our privacy officer.​

9. How to Opt-Out of Data Collection, Use or Disclosure

In addition to the method(s) described in the How to Access, Modify, Delete, or Challenge the Data Collected section, we provide the following specific opt-out methods for the forms of collection, use, or disclosure of your personal data specified below:

1. Marketing Communications. You can opt-out by if you don’t want to receive marketing communications from us, you can unsubscribe via the link in the email you received. Registered users may also unsubscribe via the communication preferences options in their profiles.
2. Push Notifications. You can opt-out  if you no longer wish to receive notifications from us, you can, where applicable, change your preferences by logging into your account or by disabling notifications in your device settings. To ensure you receive proper notifications, we will need to collect certain information about your device such as operating system and user identification information.

10. Cookie Policy

A cookie is a small file, stored on a user’s device by a website or application. Its purpose is to collect data relating to the user’s browsing habits. You can choose to be notified each time a cookie is transmitted. You can also choose to disable cookies entirely in your , but this may decrease the quality of your user experience.

11. Marketing

When you register on the Services you may be given the opportunity to elect (“opt-in”) or decline (“opt-out”) to receive updates on our latest services, news and special offers, and those of our valued affiliate service providers (“Marketing Material”), via your SmartTasker account, personal e-mail address, post or telephone. If you conclude a transaction on the Services, you may also be given the opportunity to opt- in to receive Marketing Material from SmartTasker and our valued affiliate service providers.

Once you opt-in to receive Marketing Material, you may, at any time, opt-out of receiving Marketing Material. To opt-out go to the ‘Manage Account’ link on the Services, choose ‘Settings’, then ‘Notification Settings’ and update your preferences. You can also click on the “unsubscribe” link in any email containing Marketing Material that we send you, or you can request an opt-out by emailing SmartTasker using the contact information provided on the Services. If you no longer consent to receiving Marketing Material, then you must opt-out in one of these ways.

SmartTasker may contact you as the result of a referral by another user of the Services who has provided us with contact information, such as your name and email address. The use of contact information received in connection with a referral will be governed by this Privacy Policy. You may, at any time, opt-out of SmartTasker’s referral system by emailing SmartTasker using the contact information provided on the Services.

SmartTasker reserves the right to send you administrative and account-related messages even if you opt out of receiving Marketing Material.
